1. Who we are and what this policy covers

This Privacy Policy explains how ADS Data Direct, doing business as Healthier Sports Today (“Healthier Sports Today,” “we,” “us,” or “our”), collects, uses, discloses, sells, and shares personal information when you take our surveys, visit HealthierSportsToday.com, or receive our marketing. It also explains your privacy rights and how to exercise them. Our advertising and data partners, including ADS Data Direct (“ADS”), process personal information with us as described below.

Health information: Some of our surveys ask about your health interests or medical conditions. This is “sensitive” information, and we describe how we handle it throughout this policy. If you are a Washington or Nevada resident, please also read our separate Consumer Health Data Privacy Policy, which is linked on our homepage.

2. Notice at collection – information we collect

At or before the point of collection, we collect the following categories of personal information. We collect this information from you directly (for example, through surveys and forms), automatically through cookies and similar technologies, and from third-party data providers through data appending and enrichment.

We retain each category only as long as needed for the purposes described in Section 8 (Data retention).

3. Sensitive personal information, including health data

Sensitive personal information includes the health and medical-condition information and health interests you voluntarily provide, and precise geolocation if you provide it. We collect sensitive personal information only when you submit it, and we process it for the marketing, research, and analytics purposes described below only after you affirmatively opt in.

We sell and share sensitive personal information, including health-related information, with our marketing and advertising partners and data purchasers for marketing, research, and analytics, except for residents of states that restrict or prohibit such sales. We do not sell or share the sensitive/health data of residents of Washington, Nevada, Maryland, or New Jersey, and we honor any request to limit the use of your sensitive personal information.

4. How we use personal information

  • To deliver personalized email and direct-mail marketing, offers, and promotions;
  • To deliver relevant online and digital advertising, including on social media and display networks;
  • To supplement, combine, append, and enrich your information with data from other sources;
  • To perform research, analytics, campaign measurement, and audience modeling;
  • To operate, secure, and improve our surveys, website, and services; and
  • To comply with law and enforce our terms.

5. How We Disclose, Sell, and Share Personal Information

We disclose, sell, and share the categories of personal information above with the following categories of recipients:

  • Marketing and advertising partners, including ADS Data Direct, who use the data to deliver and measure marketing on our behalf and their own.
  • Data aggregators, data brokers, and list purchasers who buy or license consumer data for marketing, research, and analytics.
  • Advertising networks and platforms used to deliver and target digital and social advertising.
  • Service providers and processors that host, secure, analyze, or send communications on our behalf under contract.
  • Downstream clients of the above who purchase marketing audiences or data.
  • Legal and successor recipients as required by law or in connection with a merger, acquisition, or sale of assets.

Server-Side Data Sharing: Data collected via our first-party pixel may be sent server-side to third-party ad networks (e.g., Meta/Conversions API) for the purposes of audience measurement and targeted advertising.

Sale and Sharing: Under laws such as the California Consumer Privacy Act, our disclosures of personal information (including sensitive/health data, where permitted) to marketing partners and data purchasers for monetary or other valuable consideration are considered a “sale,” and our disclosures for cross-context behavioral advertising are considered “sharing.” You may opt out at any time as described in Section 6.

6. Your privacy choices and rights

Do Not Sell or Share My Personal Information

You can opt out of the sale and sharing of your personal information at any time using the “Do Not Sell or Share My Personal Information” link in our website footer, or by emailing support@healthiersportstoday.com.

Limit the Use of My Sensitive Personal Information

You can direct us to limit the use and disclosure of your sensitive personal information to what is necessary to provide our services using the “Limit the Use of My Sensitive Personal Information” link in our website footer, or by emailing support@healthiersportstoday.com. You may also withdraw the consent you gave to process your health-related information at any time.

Global Privacy Control and opt-out preference signals

We recognize opt-out preference signals, including the Global Privacy Control (GPC). When we detect a GPC signal from your browser or device, we treat it as a valid request to opt out of the sale and sharing of personal information for that browser or device.

Access, deletion, correction, and portability

Depending on your state, you may have the right to know or access the personal information we hold about you, to delete it, to correct it, to obtain a portable copy, and to opt out of profiling or targeted advertising. To exercise these rights, email support@healthiersportstoday.com with the subject line “Privacy Request,” or use the request options in our footer.

How we handle requests

  • We will confirm receipt and respond within the time required by your state’s law (generally 45 days, extendable where permitted).
  • We take reasonable steps to verify your identity before fulfilling a request.
  • Authorized agents may submit requests on your behalf with proof of authorization; we may still require you to verify your identity.

Right to appeal

If we deny your request, you may appeal by emailing support@healthiersportstoday.com with the subject line “Privacy Appeal.” We will respond to your appeal within the time required by your state’s law. If your appeal is denied, you may contact your state Attorney General.

Non-discrimination

We will not discriminate against you for exercising any of your privacy rights.

7. State-specific privacy rights

California (CCPA/CPRA)

California residents have the rights described above, including the rights to know, delete, correct, opt out of sale/sharing, and limit the use of sensitive personal information, and the right to non-discrimination. The Notice at Collection in Section 2 identifies the categories we collect, sell, and share.

Virginia, Colorado, Connecticut, and other comprehensive-law states

Residents of these states have rights to access, delete, correct, and obtain a copy of their data, to opt out of targeted advertising, the sale of personal data, and certain profiling, and to appeal our decisions. We obtain your opt-in consent before processing sensitive data, including health data.

Washington and Nevada

If you are a Washington or Nevada resident, our separate Consumer Health Data Privacy Policy (linked on our homepage) governs consumer health data and describes your rights. We do not sell your consumer health data.

Maryland and New Jersey

We do not sell sensitive data, including health data, of Maryland or New Jersey residents.

8. Data retention

We keep personal information only as long as necessary for the purposes described in this policy, then delete or de-identify it. In general:

  • Survey responses and marketing profiles: retained while your consent is active and for up to [24] months after your last engagement, unless you opt out or request deletion sooner.
  • Consent and authorization records: retained for at least [6] years as proof of consent, or longer where required by law.
  • Suppression and opt-out records: retained for as long as needed to honor your choices.

Actual retention periods should be confirmed by counsel and reflected in the bracketed values.

9. Data security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure.

10. Children’s privacy

Our surveys and services are intended for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided information, contact us and we will delete it.

11. Changes to this policy

We may update this policy from time to time. We will post the updated version with a new “Last updated” date, and where required, provide additional notice.
